These Terms of Service (the "Terms") govern your use of the website at surplusfundsdiscovery.com (the "Site") and the services offered by Surplus Funds Discovery, a brand operated by Louen Labs LLC ("we," "us," or "our"). By using the Site, contacting us, or enrolling in any communication we offer, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. What we do

We are a family-run firm that helps former property owners and their heirs locate and recover surplus funds, excess proceeds, and tax overages resulting from foreclosure and tax sales. When a claim requires steps that must be handled by a licensed attorney, we coordinate with independent, licensed attorney partners to perform those steps.

We are not a law firm, and using the Site does not create an attorney–client relationship with us. This Site is for informational purposes only and is not legal, financial, or tax advice. You should consult your own professional advisors about your specific situation.

2. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use our services. If you use the Site on behalf of another person or an estate, you represent that you are authorized to do so.

3. No guarantee of recovery

Whether funds exist, whether you are entitled to them, and whether a claim can be successfully recovered depends on facts and law specific to each case. We do not guarantee any particular outcome, amount, or timeline.

4. Fees and no upfront cost

Our services are offered on a contingency basis. Our fee is a percentage of the funds recovered, within the limits each state allows. You pay no upfront fees, and if nothing is recovered, you owe us nothing.

Any recovery work is governed by the separate written agreement signed between Surplus Funds Discovery and the claimant. These Terms are general; that signed agreement controls the fee, scope, and obligations of each engagement, and it is provided to you before any work begins.

5. Your right to file on your own

You have the right to pursue your surplus funds on your own, directly with the county, court, or state, without paying us or anyone else. We will never suggest otherwise. Many people choose to have us handle the process for convenience, but the choice is always yours.

6. Text message (SMS) program terms

These terms apply to our SMS/text messaging program (the "Program") and are in addition to the rest of these Terms. By opting in, you agree to the following.

Program description

When you opt in, Surplus Funds Discovery may send you text messages relating to a possible surplus-funds matter connected to you, including case updates, appointment and document reminders, responses to your questions, and occasional messages about our services. This is an account and customer-care program; it is not a promotional list you are added to without your consent.

Your consent

We send text messages only to people who have given prior express consent to receive them — for example, by providing your mobile number and checking the SMS opt-in box on our contact form, or by otherwise expressly agreeing to be texted. Consent to receive text messages is not a condition of using our services or recovering your funds.

Message frequency

Message frequency varies based on the status of your matter and your interactions with us.

Message and data rates

Message and data rates may apply to messages we send to you and messages you send to us. For questions about your text or data plan, contact your wireless provider.

How to cancel (STOP)

You can cancel the SMS Program at any time by replying STOP to any message from us. After you send STOP, we will send you one final message confirming that you have been unsubscribed, and you will no longer receive text messages from us. If you want to rejoin, simply opt in again the same way you did originally, and we will resume sending messages.

Carrier and delivery disclaimer

Carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your wireless carrier and is not guaranteed. Surplus Funds Discovery is not responsible for any delays, failures in delivery, or errors in the transmission or receipt of any text message.

Privacy

Information you share with us through the SMS Program is handled as described in our Privacy Policy. Your mobile number and SMS consent are never shared or sold to third parties or affiliates for their marketing or promotional purposes.

7. Acceptable use

You agree not to use the Site or our services to break any law, to impersonate another person, to interfere with the operation of the Site, or to submit information you know to be false. We may decline or discontinue service at our discretion.

8. Intellectual property

The Site's content, logos, and design are owned by or licensed to us and are protected by law. You may view and share the Site for personal, non-commercial purposes, but you may not copy, resell, or reuse our content without permission.

9. Disclaimers and limitation of liability

The Site and its content are provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Site, and our total liability for any claim relating to the Site is limited to the amount you paid us, if any, for the service at issue.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The obligations that apply to any specific surplus-funds claim are also governed by the law of the state where the funds are held.

11. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and the "Effective" date above will be updated. Your continued use of the Site after changes are posted means you accept the updated Terms.
